نقش آب در درگیری‌ها: عامل، ابزار و قربانی؛ تحلیلی از منظر حقوق بشر

چکیده

بررسی گزارش‌ها و شواهد تاریخی نشان می‌دهد که از گذشته‌های دور آب و تأسیسات آبی به‌عنوان ابزار، هدف یا سلاح و اهرمی برای فشار بر طرفین اختلاف، درگیری و جنگ‌ها در بسیاری از دوره‌ها، در مقیاس‌های مختلف محلی، ملی، منطقه‌ای و حتی جهانی مورد سوءاستفاده قرار گرفته است. داده های موجود نشان میدهد که در ادوار مختلف آب به‌عنوان ابزار رقابت های نظامی و ژئوپلیتیک مورد استفاده قرار گرفته و قوانین حاضر از کفایت لازم برای محدود کردن سیاستمداران برخوردار نیست. از سوی دیگر وضع و اجرای قوانین بین‌المللی حقوق بشر و بشردوستانه طی چند قرن اخیر، نتوانسته به ‌اندازه کافی زیرساخت‌های اساسی غیر نظامی، به‌ویژه منابع آب و تأسیسات مرتبط را مورد توجه قرار داده و از آنها محافظت کند. از این‌ رو به نظر می‌رسد قوانین موضوعه ناکافی یا بعضاً نارسا و یا حتی فاقد ضمانت‌های اجرایی کافی و مناسب باشند به همین دلیل، گزارشات روند رو به ‌افزایش سوءاستفاده و درگیری‌های مرتبط با آب و حوادث خشونت‌بار علیه سیستم‌های طبیعی یا بشرساز آبی را نشان می‌دهد. این مقاله ضمن مرور و اشاره به برخی حملات و سوءاستفاده‌ها از گذشته‌های دور تا عهد حاضر، نقش خشونت علیه منابع آبی و سیستم‌های مرتبط در چارچوب قوانین بین‌المللی بشر را مورد بررسی قرار داده و در راستای رفع مشکلات حقوقی و سیاسی، راهکارهایی برای بهبود نظام‌های بین‌المللی به ‌منظور حفاظت از زیرساخت‌های حیاتی آب ارائه شده است
